Justin Timberlake's restaurant sued by employees

Justin Timberlake opened his BBQ restaurant, Southern Hospitality in July 2007 with his business partners, Eytan Sugarman and Trace Ayala.
One of the busboys, Felipe Ramales, said he worked for the restaurant for about a year and didn't get paid for tips and overtime. Ruh roh!
He alleges that the restaurant automatically charges six or more diners with gratuity that he and other employees never got as well as working more than 40 hours in a week and not getting overtime.
Ramales filed the suit on behalf of 50 other employees which they're seeking unspecified damages.
A manager at the restaurant, Chris Russell says that all of the employees received every dime of their tips and the busboys were paid well over minimum wage.
I'm just curious as to how they're going to prove that the employees were given their tips.
